The different categories of temporary resident services offered are described here below.

Once you are in Canada, you may extend your stay or even amend your status under certain conditions. Tourists, students and workers constitute classes of the temporary resident program and are legally authorised to enter Canada temporarily to mainly visit, study and/or work. They are restricted in length of stay and are subject to various other conditions as explained in previous relevant sections. If a temporary resident stays longer than he is allowed by his visa/permit, he will then lose his temporary resident status and he could be asked to leave Canada. You must apply to extend/renew your stay if you want to visit, study or work longer in Canada.

Moreover, you must also apply to amend your status/visa/permit if you want to change the conditions of your stay (for example, if you are currently studying or working in Canada, and you want to change job or study in a different university) or the type of your visa/permit (for example, from a study permit to a work permit). It is advisable that you make the request for extending/renewing your stay prior to the expiry date of your status so that your original temporary status (as a tourist, student or as a worker) is maintained under the same conditions until a new decision is made. Some specific/additional steps may apply whether your tourist visa, study permit or work permit has expired less than 90 days ago or more than 90 days ago., thanks to its expertise, can advise you on procedures to follow and how to apply for an extension, a renewal or an amendment of your stay, be it for visit, study or work.

The Canada-Quebec Accord is an agreement, signed in 1991, which specifies that [the province of] Quebec is solely responsible for the selection of applicants destined to the various regions and cities of Quebec. On the other hand, federal responsibility under the Canada-Quebec Accord is to assess an applicant’s admissibility and issue temporary or permanent resident visas. Therefore, a visa officer may refuse applicants even if they have already been selected by Quebec in case they prove to be inadmissible. Likewise, the visa officer will not issue a temporary or a permanent resident visa to applicants destined to Quebec who have not met Quebec’s selection criteria even if these applicants would have been deemed admissible according to federal requirements.

There are different factors that HRSDC takes into consideration when assessing an application for a labour market opinion, and the prospective foreign worker and his potential employer must meet some conditions in order to receive a positive or neutral LMO. Canadian immigration authorities at visa offices abroad may also have some additional criteria when issuing work permits to foreign workers in specific occupations. The HRSDC confirmation is typically given for a limited period of time, and the work permit issued to coincide with this period. Renewal of a work permit beyond the specified period will consequently require a new LMO from HRSDC.

These admissibility criteria are applicable without exception to all candidates who want to come to Canada. If any of the following examples apply to your case, it will constitute an inadmissibility factor that could render inadmissible your application:

  • Inadmissible medical status
  • Presence of criminal record or evidence of threat to Canada’s national security
  • Insufficient funds to sustain living expenses and/or unavailability of adequate settlement funds
  • Misrepresentation through withhold and/or distortion of facts and/or production and/or use of fake documents
  • Non-compliance with the visa/immigration officers instructions
  • Change in family composition and/or marital status, without noticing the Canadian immigration authorities in due time
